Making sense of the draft Planning and Design Code — Part Eight — Industrial Land Uses

This Paper is Part Eight and our final Paper in our series on Phases 2 and 3 of thae draft Planning and Design Code (“the Code”). The Code is currently out for public consultation. Consultation on Phase 3 is scheduled to end on 28 February 2020.

The focus of Paper Eight is industrial land uses and the procedural requirements that apply in each Zone, as well as the referral requirements.

In the table attached, each relevant Zone is identified and we comment on the processes and procedures that apply to industry developments.

Referrals

Unsurprisingly, industrial land uses comprise referral ‘triggers’ in various Overlays within the draft Code.  Each ‘trigger’ is set out in the table attached.

Each of the ‘triggers’ should be carefully reviewed by councils and comments provided to the State Planning Commission where the opinion is held that they require broadening or restricting in certain areas.
